The rules for using Outdoor Grid, for shops, their teams and their guests.

What these terms cover

These terms apply when you use Outdoor Grid: the app for shop owners and staff at outdoorgrid.ai, and the booking pages shops put online with it. Outdoor Grid is provided by HOWTHEF AI, LLC (HowTheF, "we", "us").

By using Outdoor Grid you agree to these terms. If you do not agree, please do not use it. If your shop has signed a separate written agreement with us, that agreement wins where it says something different.

What Outdoor Grid is

Outdoor Grid is software that helps rental and tour shops take bookings, prepare equipment, hand it out and take it back, run tours and answer guests. The shop runs its business; Outdoor Grid is the tool it uses. We do not rent equipment or run tours ourselves.

A service in early development

Outdoor Grid is in an early pilot with a small number of shops. Features can change, and the service may sometimes be unavailable.

Online deposits run in test mode for now. No real money is taken. We tell each shop before real payments start.

Accounts

  • Accounts are by invitation. The shop owner decides who joins the team and what each person can do, and is responsible for what the team does in Outdoor Grid.
  • Keep your sign-in to yourself. Do not share your password.
  • If you think someone else has used your account, tell us at hello@howthef.ai straight away.
  • You must be an adult to have an account.

What the shop is responsible for

  • What the team enters: prices, what is available, opening times, cancellation rules, rental terms and tour details.
  • The rentals and tours themselves: the equipment, its safety, the guides, insurance, and the contract with each guest.
  • Following the laws that apply to its business, such as consumer, tax, invoicing and safety rules.
  • Its guests' personal data: the shop decides what it collects and why, has a legal reason for it, and tells guests in its own privacy policy. We handle that data only for the shop, under the data processing terms we agree with it and as our privacy policy describes.
  • The accounts it connects, such as WhatsApp, Instagram, Messenger, email or Stripe, and following those services' own rules.

The scope of the pilot and any fees are agreed with each shop in writing before it starts.

For guests who book online

  • You book with the shop, not with us. The shop's prices, cancellation rule and rental terms apply. You see the cancellation rule before you pay.
  • Your booking is confirmed when you see the confirmation page and get the confirmation email. Sometimes the shop has to confirm your items first; the page then says so and the shop will contact you.
  • Please give correct details. The shop uses them to get the right equipment ready for you.
  • For questions about your booking, changes, refunds or the equipment, contact the shop. Its address and phone number are on its booking page and in your confirmation.

Payments

Online payments run through Stripe Connect. Each shop opens its own Stripe account and is the seller: the guest pays the shop, and the money goes from the guest's card to the shop's Stripe account. We never receive, keep or pass on guests' money.

  • A shop that takes payments must accept Stripe's terms, including the Stripe Connected Account Agreement (https://stripe.com/legal/connect-account). Stripe's own fees apply.
  • Refunds, chargebacks and disputes about a booking are between the shop and its guest. Outdoor Grid shows the shop what was paid and what is still to pay.
  • What a shop pays us for Outdoor Grid is agreed with the shop in writing, separately from what guests pay the shop.
  • Thirty-day money-back guarantee: if a shop is not happy within the first thirty days after it starts paying us, we refund what it paid for that period on request. Write to hello@howthef.ai.

The AI assistant

A shop can let an AI assistant answer guests and suggest bookings. The assistant writes its answers with an AI model, and AI can be wrong.

  • For shops: you decide whether to turn it on and what it may do, you keep the information it uses up to date, and you stay responsible for what it tells your guests. Your staff can step in at any time.
  • For guests: the assistant speaks for the shop. A booking counts only once it is confirmed. For anything important, such as safety, conditions or prices, check with the shop.
  • The assistant gives no legal, medical or safety advice.

Using Outdoor Grid properly

Please do not:

  • share your sign-in with other people;
  • try to see another shop's information;
  • use bots or automatic tools to book, copy the service, or try to overload it;
  • try to break or get around the security of the service;
  • use Outdoor Grid for anything illegal, to send spam, or to upload content that is unlawful or not yours to use.

We may pause or close an account that breaks these rules. Where we can, we tell the shop first and give it a chance to fix the problem.

Who owns what

  • Outdoor Grid, its software, design and name belong to us. Using it gives you the right to use it, not to own or copy it.
  • A shop's information, such as its equipment, prices, bookings and photos, belongs to the shop. The shop lets us use it only to run Outdoor Grid for the shop.
  • If you send us ideas or feedback, we may use them to improve Outdoor Grid, without owing you anything.

Availability and changes to the service

We work to keep Outdoor Grid running and correct, but we cannot promise it will never fail or be interrupted, for example for maintenance or because a provider we rely on fails. We may change or remove features. If a change takes away something a shop relies on, we tell the shop in good time.

Our responsibility

As far as the law allows, Outdoor Grid is provided as it is, without promises beyond those in these terms or in a written agreement with your shop.

As far as the law allows, we are not responsible to shops for lost profits, lost bookings or other indirect losses, and our total responsibility to a shop is limited to what the shop paid us for Outdoor Grid in the 12 months before the problem.

Nothing in these terms limits a responsibility that the law does not allow us to limit, such as for death or injury caused by our negligence, for fraud, or for harm we cause on purpose or by gross negligence. If you are a consumer, you keep all the rights the law of your country gives you.

If a claim is made against us

A shop protects us against claims from its guests or others that come from its rentals, tours, content or its breaking the law or these terms, and covers the reasonable costs of those claims. This does not apply where we caused the problem.

Ending

A shop can stop using Outdoor Grid at any time, as its written agreement with us says. We may end the service for a shop that seriously or repeatedly breaks these terms, or after telling it in good time if we stop running Outdoor Grid.

When a shop leaves, we hand over its information if it asks, and then delete it. See "Delete my data".

Which law applies

These terms are governed by the laws of the State of Delaware, USA; disputes go to the state and federal courts located in Delaware. If you are a consumer in the EU, the EEA or the UK, you also keep the protection of the mandatory laws of the country where you live, and you can take a claim to the courts there.

Changes to these terms

We may change these terms. For important changes we tell shop owners by email at least 30 days before they apply. The date at the top shows the last update. If a shop does not agree to a change, it can stop using Outdoor Grid before the change applies.
